Settlement agreement reached in ADR point online mediation
An online mediation was successfully completed by ADR point. The case concerned a dispute between a Greek tenant and a Scottish Real Estate Company. The leased property did not meet the lease terms, had security issues, electricity wiring & gas pipes supplies was in poor condition, the house was delivered unpainted & kitchen appliances were not working. The tenant signed the lease remotely before arriving in Scotland, without seeing the property and knowing English and gave a down payment of almost one year rentals amount. At some point they left the house, denounced the contract and raised a series of claims. The Real Estate Company denied any prior knowledge of the house condition and insisted on the signed lease agreement. The parties agreed to use mediation before going to the court. The tenant filed a mediation request to ADR point. The Real Estate accepted. The Agreement to Mediate was signed by both parties, scanned and sent to mediator and the original copies were sent for signature by speed post. The process was conducted online, lasted 7 hours and ended with a settlement agreement which provided for the return of 6 months rentals to the tenant, recognition of the date of termination of the lease, no compensation to tenant for works carried out in the house etc.
